All-inclusive out-of-court assistance
Since a few years, courts may impose mediation on parties while legal proceedings are pending, and several courts have even set up special conciliation chambers. The role of a lawyer is crucial in these alternative dispute resolutions. Fortunately, several of our lawyers are trained to these processes.
In all our practice areas, we assist our clients through the entire mediation/conciliation process, from the first meeting with the mediator or the conciliating judge, then through the negotiation phase, and up to the drafting of the settlement agreement (if any). Our role is also to keep our client informed of the legal framework and consequences of the discussed amicable solutions so that our client can make a fully-aware decision.

At Simont Braun, we have several experts in mediation: Thomas Braun, Charlotte de Leval, Fanny Laune and Alexia Faes are registered mediators to the “Commission FĂ©dĂ©rale MĂ©diation”.Â
Thomas Braun is also an active member of the new Special Committee on Construction within the “Commission Fédérale Médiation”. Emmanuel Cornu was involved in the first mediation proceedings organised by the Boards of Appeal of the EUIPO (European Union Intellectual Property Office).
