Real Estate and Construction

Real estate projects are becoming more and more complex as the sector not only has to deal with an ever-increasing number of parties involved, but also new regulations and administrative requirements (relating to environmental law, consumer protection, security, data protection, etc.), all of which have a major impact on every phase of a real estate project.

Integrating such aspects from the earliest possible stage is a key success factor, as it favours accurate risk assessment and offers legal certainty.

Our Services

Simont Braun offers solid and long-standing experience in the organisation and development of real estate projects, including the drafting of contractual documentation at all stages, the financing and tax structure of the real estate operation and client assistance during litigation. The team is also very well connected with the real estate market and enjoys an excellent reputation among public authorities - as demonstrated by the projects we handle.
The team assists Belgian and foreign-based investors, banks, project developers, public entities, companies and private individuals (architects, contractors, engineers, etc.) in all their real estate operations, projects and issues, whether they concern public services, housing, office buildings, shopping malls or cultural centres.
Simont Braun also advises clients on the management, optimisation and reorganisation of real estate portfolios.
As and when required, we represent their interests before all judicial and administrative courts, before the Constitutional Court and in mediation and arbitration proceedings.

Simont Braun is also widely renowned for its expertise in all aspects of construction law, where we assist all types of operators in the market. Thomas Braun is a recognised mediator in construction matters.

Our Approach

Our team is actively involved in all relevant legislation. This is an essential activity, notably due to the regionalisation of many aspects of legislative developments, such as tax and administrative law. Manuela von Kuegelgen has drafted a complete overhaul of the Housing Code for the Bruxelles-Capitale Region (Brussels). She has also prepared the legislative texts relating to the STIB/MIVB’s easement (Brussels public transport company) in the context of the Metro Nord project.
Simont Braun is one of the sole law firms in Belgium where the real estate and public & administrative law team is a single team working in a fully integrated manner. This single team is capable of handling matters incorporating both real estate and public/administrative aspects, while offering advice on the most demanding of issues in the field. Our associates' training ensures that they are equally specialised in both practice areas. This is a major benefit for our clients as their multi-disciplinary projects will be handled by one team, and not divided between several departments.

Our team collaborates closely with other departments, notably Tax, Labour Law, Corporate/M&A and Banking & Finance.
